Within the last few years, the U.S. Department of Health and Human Services (HHS) launched its “Regulatory Sprint to Coordinated Care” initiative to accelerate the transition to a value-based health care system focused on care coordination. As part of this initiative, HHS expressed an intent to identify regulatory requirements that act as obstacles to coordinated care and then issue guidance or revise regulations to address these obstacles and incentivize coordinated care. Since then, HHS has revised federal regulations governing the confidentiality of patient records created by federally-assisted substance use disorder treatment programs, known as 42 CFR Part 2. In early 2020, U.S. Congress then amended the enabling statute for 42 CFR Part 2 for the first time in decades. This will result in yet another round of new regulations needed to implement these new statutory changes. On December 10, 2020, HHS then released proposed changes to the HIPAA Privacy Rule to similarly remove such barriers to care coordination. These changes, as well as those still coming, will further facilitate providers use of EHRs and HIEs for behavioral health and care coordination.
